Event Policies
Cancellation Details:
Any cancellation made after the date specified in your event confirmation e-mail will not be entitled to a refund.
Notice of Video/Audio and Photography
By registering for and/or attending the Event, I acknowledge and agree that video, photographs, and or other recording of the Event may be taken by the Greater Cincinnati Northern Kentucky Apartment Association (GCNKAA) or Partners acting on behalf of GCNKAA, and these photographs, videos or other recordings of my image, likeness and/or voice may be used by GCNKAA in any media now or later invented for any purpose related to the GCNKAA mission including educational, promotional, and awareness related use without compensation.
By registering for and/or attending the Event I give to GCNKAA unlimited permission to use my name, likeness, image, statements and other information I may give to GCNKAA, whether through registration, at the Event, or otherwise, that may be necessary for GCNKAA to make use of its rights in the photographs, video, and other recordings.
This authorization is continuous and may only be withdrawn by specific rescission of this authorization.
Indemnification Release
By registering for and attending the Greater Cincinnati Northern Kentucky Apartment Association (“GCNKAA”) Events and to the furthest extent allowed by law, and signified by entering the event facility or event area for and GCNKAA Event, the Attendee/Participant (“Attendee”) agrees to release and indemnify, defend, and hold harmless the GCNKAA and its officers, directors, volunteers, sponsors and employees (hereinafter referred to as “Released Party”) from and against any and all claims, actions, liabilities, damages, losses, fines, penalties, or expenses, whether in contract, tort or strict liability, or including reasonable court costs, attorneys’ fees, and costs of claim processing, investigation and litigation (hereinafter referred to as “Claims”) for bodily injury or personal injury, including death, caused, or alleged to be caused in whole or part, incurred by Attendee, arising or alleged to have arisen directly or indirectly out of the Attendee’s participation in the Event. Further, Attendee releases and indemnifies the Released Parties from all property loss or damage suffered while participating in the Event. Attendee’s obligations under the preceding sentences shall apply regardless of whether GCNKAA or any of its officers, directors, employees, agents or volunteers are negligent, but shall not apply to any losses or damages caused solely by the gross negligence, or caused by the willful misconduct, of GCNKAA or any of its officers, directors, employees, agents, sponsors or volunteers.
It is the specific intention of the parties that the Released Parties shall, in all instances, except for Claims arising solely from the negligent or willful acts or omissions of the Released Parties, be released and indemnified by Attendee from and against any and all claims. It is agreed that Attendee will be responsible for primary loss investigation, defense and judgment costs where this indemnification is applicable.
GCNKAA shall be reimbursed for all attorney’s fees and costs incurred by GCNKAA in enforcing this Agreement.
Participation in the Event includes not only attending or participating in the event and the inherent risks associated with any activities related to the event, but also use or operation of any equipment, and participation in any special events, games or activities provided on the event facility or by any of the event sponsors or participants.
You have read and agree to comply with, and to cause the Event to comply with, all of the foregoing provisions. In addition, you agree to hold harmless, defend and indemnify the GCNKAA, and their boards, employees and agents from and against any claims, injuries, causes of action, damages and expenses, including attorney’s fees, resulting from or arising out of the service or consumption of alcohol at the Event or any failure of the Event to comply with any of the provisions of this Addendum.
Use of GCNKAA and Event Names; Ancillary Events
Sponsor/Exhibitor acknowledges and agrees that it may not use the name “GCNKAA,” “Greater Cincinnati Northern Kentucky Apartment Association,” the official name of the Event, or any variation, abbreviation, or logo of the foregoing in any promotional materials, invitations, signage, social media posts, emails, or other communications for any pre-Event, post-Event, hospitality suite, party, reception, dinner, networking gathering, or any other ancillary event or activity (collectively, “Ancillary Events”).
Sponsor/Exhibitor further agrees that it shall not imply, suggest, or create the appearance that any Ancillary Event is endorsed, sponsored, affiliated with, or officially connected to GCNKAA or the Event. All Ancillary Events must be clearly and conspicuously identified as independent activities organized solely by the Sponsor/Exhibitor and not affiliated with GCNKAA.
Any violation of this provision shall constitute a material breach of this Agreement and a violation of the Code of Conduct. In addition to any other remedies available to GCNKAA, the Association may immediately revoke the Sponsor/Exhibitor’s participation in the Event, remove the Sponsor/Exhibitor and its representatives from the premises, and retain all payments made with no refund.
Code of Conduct And Event Policies For Sponsors
Representative Obligations and Higher Standard As a sponsor, you acknowledge and agree that you are entering into this Agreement on behalf of yourself and on behalf of all employees, agents, contractors, affiliates, and other members of your company/organization who may attend, staff your exhibit, or otherwise participate in or be affiliated with your sponsorship at the Event. You represent and warrant that you have full authority to bind all such parties to the terms of this Agreement, including this Code of Conduct.
As a sponsor and representative of GCNKAA, you and your company/organization are held to a higher standard of conduct. Your actions reflect directly on the Association and its reputation. Failure to act responsibly can open the Association to significant legal risk and potential liability.
Consequences of Violation GCNKAA reserves the right to determine, in its sole discretion, whether any conduct violates this Code of Conduct. If any violation occurs, GCNKAA may immediately remove you and/or any member of your company/organization from the Event (and any related activities) without refund of any sponsorship fees, booth fees, or other payments made. You and your company/organization will also remain responsible for any additional costs or damages incurred by GCNKAA as a result of the violation. Such removal shall not relieve you of your other obligations under this Agreement.
Acknowledgment and Agreement By sponsoring, you confirm that you have read, understand, and agree to this Code of Conduct and Representative Obligations section on behalf of yourself and all members of your company/organization. You further agree that these terms are material to GCNKAA’s willingness to accept your sponsorship.
Code of Conduct for Sponsors
As a sponsor, you and all representatives of your company/organization agree to abide by the following Code of Conduct at all times while participating in or attending the Event:
- Maintain the highest standards of professionalism, integrity, and respect toward all attendees, exhibitors, speakers, staff, volunteers, and GCNKAA representatives.
- Refrain from any form of harassment, discrimination, disruptive behavior, or inappropriate conduct, including but not limited to verbal, physical, or visual actions that could reasonably be considered offensive or intimidating.
- Comply with all applicable federal, state, and local laws, as well as all Event rules, venue policies, and GCNKAA guidelines.
- Present all marketing, promotional, and sales activities in a manner that is truthful, ethical, and consistent with the mission and values of GCNKAA.
- Respect the rights of others to participate fully in the Event without interference.
- Wear appropriate business attire and Event credentials at all times.
- Immediately report any violations of this Code of Conduct to GCNKAA staff.
Liquor Licenses and Outside Food or Beverage Policy
Most event facilities hold a liquor license that does not allow for outside alcohol to be brought into the facility or onto the grounds of the event venue. Outside alcohol brought in by members, guests, and event attendees is a direct violation of State liquor law and is cause for immediate expulsion from the event with no refund and could jeopardize your association membership as it would be a violation of the ethics clause.
